Other Useful Information: This was the culmination of three lawsuits. The first being against the wrecker company that came to the aid of the decedent after her car broke down. The issues involved in the case were non-permissive use and contributory negligence/assumption of the risk. The second lawsuit was in the nature of a declaratory judgment on the issue of permissive use. The jury found there was permissive use and the insurance company was responsible. The case was settled the night before trial for the sum of $375,000.
